Abstract/Description:

This chapter gives an overview of the Greek system of protection of privacy and data protection in a digital environment. The analysis shows that the Greek legal system is equipped with a set of provisions (constitutional and secondary legislation) on the protection of privacy, which fully responds to the principles laid down in the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union. Hence, the existing normative landscape is clear, satisfactory and in conformity with modern conceptions of privacy and personal data protection. However, the judicial implementation of these provisions is often characterized by inconsistencies which throw into question the certainty of the legal system of protection of privacy. The chapter concludes by suggesting that the rate of technological change may have in this case outstripped the ability of the judicial system to familiarize itself with the new emerging technologies and to respond to them in a coherent way.
