Abstract/Description:
This chapter provides commentary on art. 40 of the CRC on children’s rights in juvenile justice systems. The chapter elaborates on the rights of every child alleged of, accused of or recognised as having infringed the penal law, to fair and child-specific treatment and in particular, a fair trial and due process in line with general human rights law principles. Minimum age of criminal responsibility (MACR), alternatives to institutional care and prevention are addressed separately.
