Abstract/Description:

The chapter provides an overview of existing specialized general IP and patent courts at the European and world-wide level. The focus lies on the future European Unified Patent Court with jurisdiction concerning the infringement and revocation of classic European patents and future Unitary patents. It will be the first common European civil court that will work under its own rules of procedure. The chapter not only explains the structure of the court but also provides a comparative law analysis of the rules of procedure that provide an interesting compromise between the common law and continental law approach;
