Over the last decade, Spain has undertaken two very important reviews of copyright law. Such reviews were primarily aimed at transposing Directives on copyright, including Directive 2001/29. With respect to the latter, the Spanish legislator went beyond its standards, most significantly providing for creative equitable remuneration rights in several instances. During that time, Spanish courts have also shown an interesting evolution in the application of copyright law, most significantly in the field of online copyright infringement – encouraged by the Court of Justice of the EU, to be sure. The most recent amendment of the Spanish copyright law was approved some time after this chapter was written, by April 13, 2018, finally transposing the 2014 Directive on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market. This transposition, hugely overdue, is presently in the process of being reviewed by Congress.
