Abstract/Description:

The Uniform Domain Name Dispute Resolution Policy (UDRP) provides for an extrajudicial method of resolving disputes between registrants of domain names and trademark holders who allege cybersquatting. The UDRP process stands in contrast to traditional arbitration, but borrows much from the arbitration method, especially in the international context. This chapter highlights the similarities and distinctions between a proceeding in arbitration and one under the UDRP. Ultimately, when a party alleges that an internet domain name infringes on its trademark rights, the UDRP method is an option that should be considered.
