A Bill for

An Act to amend the Corrections Management Act 2007









The Legislative Assembly for the Australian Capital Territory enacts as follows:

1 Name of Act

This Act is the Corrections Management (Mandatory Urine Testing) Amendment Act 2010.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Legislation amended

This Act amends the Corrections Management Act 2007.

4 New section 133A

in division 9.6.2, insert

133A Alcohol and drug testing of detainees—random selection of AMC detainees

(1) The chief executive must prepare a list each month of randomly selected detainees for the correctional centre (the AMC) that includes the Alexander Maconochie Centre.

(2) The number of detainees on the list must be at least 5% of the total number of detainees on the register of detainees for the AMC on the day the chief executive prepares the list.

(3) In this section:

randomly selected detainee means a detainee selected by a computer programmed to select names randomly from the register of detainees.

5 Alcohol and drug testing of detainees

Section 134 (1)

substitute

(1) The chief executive—

(a) may direct a detainee to provide a stated kind of test sample; and

(b) must, each month, direct each detainee on the list mentioned in section 133A for the month to provide a test sample that is a urine sample.
