Gaming Machine (Political Donations) Amendment Bill 2003





A Bill for

An Act to amend the Gaming Machine Act 1987









The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Gaming Machine (Political Donations) Amendment Act 2003.

2 Commencement

This Act commences on 1 July 2004.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Act amended

This Act amends the Gaming Machine Act 1987.

4 New section 30I

in division 4.5, insert

30I Political donations prohibited

(1) A club that is a licensee must not give money to a political party or associated entity.

(2) If the commission is satisfied that a club that is a licensee has contravened subsection (1), the disciplinary action that the commission may take under section 24 (1) includes, but is not limited to, the imposition by way of a condition on the club’s licence of a restriction (or further restriction) on the number of gaming machines that may be installed on the licensed premises.

Note Other disciplinary actions the commission might take under s 24 (1) are as follows:

• censure

• imposition or variation of other licence conditions

• imposition of a monetary penalty of not more than $10 000

• suspension of the club’s licence for a stated period or until a stated condition is fulfilled

• suspension of the club’s licence indefinitely

• cancellation of the club’s licence.

(3) In this section:

associated entity—see the Electoral Act 1992, section 198.

political party—see the Electoral Act 1992, dictionary.
