A Bill for

An Act to amend the Holidays Act 1958, and for other purposes













The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Holidays (Canberra Day) Amendment Act 2007.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Legislation amended

This Act amends the Holidays Act 1958.

Note This Act also amends the Road Transport (Offences) Regulation 2005 (see s 6).

4 Public holidays

Section 3 (1) (a) (iii)

substitute

(iii) the 2nd Monday in March (Canberra Day);

Note For 2007, the Canberra Day public holiday is 19 March 2007 (ie the 3rd Monday in March (see s 6)).

5 New section 6

insert

6 Canberra Day public holiday for 2007

(1) Despite section 3 (1) (a) (iii), the Canberra Day public holiday for 2007 is 19 March 2007.

(2) Subsection (1) is a law to which the Legislation Act, section 88 (Repeal does not end effect of transitional laws etc) applies.

(3) This section and the note to section 3 (1) (a) (iii) expire on 19 March 2008.

6 Road Transport (Offences) Regulation 2005, section 22 (3) and (4)

substitute

(3) A declaration under subsection (1) (e) is a disallowable instrument.

Note A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act.

(4) In this section:

public holiday means a public holiday under the Holidays Act 1958 other than—

(a) the 2nd Monday in March (Canberra Day); and

(b) a day, or part of a day, declared under that Act, section 3 (1) (b) to be a public holiday; and

(c) a day declared under that Act, section 3 (2) not to be a public holiday; and

(d) 19 March 2007.

(5) Subsection (4), definition of public holiday, paragraph (a) applies only to a year after 2007.

(6) Subsection (4), definition of public holiday, paragraph (d) and subsection (5) are laws to which the Legislation Act, section 88 (Repeal does not end effect of transitional laws etc) applies.

(7) Subsection (4), definition of public holiday, paragraph (d), subsections (5) and (6) and this subsection expire on 19 March 2008.
