A Bill for

An Act to amend the Legislation Act 2001













The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Legislation Amendment Act 2005.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Legislation amended

This Act amends the Legislation Act 2001.

4 New chapter 5A

Chapter 5A Explanatory statements

38A Meaning of explanatory statement for ch 5A

In this chapter, an explanatory statement, for a bill that is presented to the Legislative Assembly, is a document that—

(a) explains the policy intent of the bill; and

(b) describes the legal effect of the individual clauses of the bill; and

(c) includes other matters that the member who presents the bill wishes to include—

(i) for the information of the Assembly; or

(ii) as an aid to interpretation under section 142 (Non-legislative context—material that may be considered).

38B Explanatory statement to accompany bill

When a member of the Legislative Assembly presents a bill to the Assembly, the member must also present an explanatory statement.

38C Explanatory statement to include consultation report

The explanatory statement must include a report on the consultation that has been undertaken.

Examples of consultation

1 consultation with community groups

2 consultation with individuals who may be affected by the legislation

3 consultation with government agencies or departments

Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see s 126 and s 132).

5 Dictionary part 2, new definition of explanatory statement
