Supreme Court (Appointment of Resident Judges) Amendment Bill 2013

A Bill for

An Act to amend the Supreme Court Act 1933









The Legislative Assembly for the Australian Capital Territory enacts as follows:

1 Name of Act

This Act is the Supreme Court (Appointment of Resident Judges) Amendment Act 2013.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act

, s 75 (1)).

3 Legislation amended

This Act amends the Supreme Court Act 1933

.

4 Resident judges

Section 4 (1)

substitute

(1) The Executive must by commission appoint, as resident judges—

(a) a Chief Justice of the court; and

(b) at least 4 other judges of the court.

5 New section 4 (5)

insert

(5) If at any time there are fewer than 5 resident judges holding office under this section, the Executive must appoint as many additional resident judges as are needed to ensure that there are at least 5 resident judges of the court.
