Outline
The Long Service Leave
(Contract Cleaning Industry) Act (LSL Cleaning
Act) creates a portable long service leave scheme for workers in the contract
cleaning industry. Under the scheme workers are entitled to take long service
leave after 10 years of service. The costs of long service leave are met by
contributions made by employers for each employee to the Cleaning Long Service
Leave Board.
Section 64 of LSL Cleaning Act
requires employees who are entitled to long service leave under both the LSL
Cleaning Act and the Long Service Leave Act 1976 (LSL Act) to choose the
law they wish to use to access their entitlement. This section also ensures that
where employers make payments to employees who elect for the LSL Act, the Board
administering the LSL Cleaning Act must repay the employer for the contributions
the employer made.
Currently subsection (6) is a sunset provision which
effectively ends section 64 on 31 December 2006. This bill will remove
subsection (6).

This clause establishes the name of the Act
as the Long Service Leave (Contract Cleaning Industry) Amendment Bill
2006.
2. Commencement
This is a formal provision specifying when the
Act will commence. The Act commences on the day after its notification
day.
3. Legislation amended
This clause provides that the purpose of the
bill is to amend the Long Service Leave (Contract Cleaning Industry) Act
1999.
4. Benefits under other laws
Section 64
(6)
Currently section 64(6) provides that
section 64 will expire on 31 December 2006. The purpose of the
amendment is to remove this expiration date so that section 64 continues to
operate after 31 December 2006.
