ELECTORAL ACT 1992 - SECT 157

Spoilt ballot papers

    (1)     An officer shall issue another unused ballot paper to an elector who—

        (a)     satisfies the officer that a ballot paper previously issued to the elector has been inadvertently spoiled; and

        (b)     gives the spoilt ballot paper to the officer.

    (2)     An officer who receives a spoilt ballot paper shall—

        (a)     write ‘spoilt' on the back of it; and

        (b)     place it in an envelope, seal the envelope and endorse it so as to indicate the type of spoilt ballot paper enclosed; and

        (c)     sign the endorsement.

    (3)     At the close of polling, the OIC shall enclose the envelope in a sealed parcel and give it to the commissioner.

    (4)     This section does not apply in relation to an elector who votes electronically.
