ELECTORAL ACT 1992 - SECT 159

Extension of time for conducting elections

    (1)     Despite any other provision of this Act, before or after the day when an election is required to be held, the Executive may, by written notice, make provision for—

        (a)     extending the time for holding the election; or

        (b)     meeting any difficulty that might otherwise interfere with the due conduct of the election;

and any provision so made shall be valid and sufficient for that purpose.

    (2)     A notice under subsection (1) is a notifiable instrument.

Note      A notifiable instrument must be notified under the Legislation Act 2001

.

    (3)     The commissioner must give additional public notice of the notice required under this section.

Note     Public notice means notice on an ACT government website or in a daily newspaper circulating in the ACT (see Legislation Act

, dict, pt 1). The requirement in s (3) is in addition to the requirement for notification on the legislation register as a notifiable instrument.
