ELECTORAL ACT 1992 - SECT 256

Validity may be disputed after election

    (1)     The validity of an election shall not be disputed except by application to the Court of Disputed Elections after the result of the election is declared.

    (2)     Without limiting subsection (1), if any of the following matters in relation to an election is called into question, the validity of the election is to be taken to be in dispute:

        (a)     the acceptance or rejection of a nomination of a candidate by the commissioner;

        (b)     the eligibility of a person to be nominated as a candidate, to be elected or to be an MLA;

        (c)     any matter connected with the printing or endorsement of ballot papers;

        (d)     any matter connected with the issue, or scrutiny, of ballot papers by the commissioner or an officer;

        (e)     any matter connected with electronic voting;

        (f)     any matter connected with the admission or rejection of declaration votes by an officer at the preliminary scrutiny.
