ELECTORAL ACT 1992 - SECT 297

Misleading electoral matter affecting casting of vote

    (1)     A person shall not disseminate, or authorise to be disseminated, electoral matter that is likely to mislead or deceive an elector about the casting of a vote.

Maximum penalty: 50 penalty units, imprisonment for 6 months or both.

    (2)     It is a defence to a prosecution for an offence against subsection (1) if it is established that the defendant did not know, and could not reasonably be expected to have known, that the electoral matter was likely to mislead or deceive an elector about the casting of a vote.
