LIQUOR ACT 2010 - SECT 108

Offence—abuse, threaten, intimidate staff

    (1)     A person commits an offence if—

        (a)     a staff member at premises refuses to supply liquor to the person because the person is intoxicated; and

        (b)     the person engages in abusive, threatening or intimidating behaviour towards the staff member; and

        (c)     the behaviour is because of the refusal.

Maximum penalty: 10 penalty units.

Note     Supply includes sell (see dict).

    (2)     A person commits an offence if—

        (a)     a staff member refuses to supply liquor to an intoxicated person; and

        (b)     the person engages in abusive, threatening or intimidating behaviour towards the staff member; and

        (c)     the behaviour is because of the refusal.

Maximum penalty: 10 penalty units.

    (3)     An offence against this section is a strict liability offence.
