LIQUOR ACT 2010 - SECT 119

Offence—send child or young person to obtain liquor

    (1)     A person commits an offence if—

        (a)     the person sends another person to buy liquor or low-alcohol liquor at—

              (i)     licensed premises; or

              (ii)     catered premises; or

              (iii)     permitted premises; and

        (b)     the other person is a child or young person.

Maximum penalty: 10 penalty units.

    (2)     A person commits an offence if—

        (a)     the person sends another person to collect liquor or low-alcohol liquor at—

              (i)     licensed premises; or

              (ii)     catered premises; or

              (iii)     permitted premises; and

        (b)     the other person is a child or young person.

Maximum penalty: 10 penalty units.

    (3)     This section does not apply in relation to a young person if the young person is sent to obtain liquor or low-alcohol liquor in the course of—

        (a)     the young person's employment at the premises; or

        (b)     a training program conducted by a declared training provider.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (3) (see Criminal Code

, s 58).
