LIQUOR ACT 2010 - SECT 12

Offence—sell liquor without licence or permit

    (1)     A person commits an offence if the person—

        (a)     sells liquor to someone else; and

        (b)     does not hold a licence or permit authorising the sale.

Maximum penalty: 100 penalty units, 12 months imprisonment or both.

    (2)     This section does not apply if the sale happens at a private event at which not more than 30 people are present.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (2) (see Criminal Code

, s 58).
