(1) A person commits an offence if—
(a) the person is a licensee; and
(b) the person conducts a prohibited promotional activity; and
(c) the activity is conducted at the licensed premises.
Maximum penalty: 50 penalty units.
(2) A person commits an offence if—
(a) the person is a permit-holder; and
(b) the person conducts a prohibited promotional activity; and
(c) the activity is conducted at the permitted premises.
Maximum penalty: 50 penalty units.
(3) A person commits an offence if—
(a) the person is a licensee; and
(b) another person conducts a prohibited promotional activity; and
(c) the person knows about the activity; and
(d) the activity is conducted at the licensed premises.
Maximum penalty: 50 penalty units.
(4) A person commits an offence if—
(a) the person is a permit-holder; and
(b) another person conducts a prohibited promotional activity; and
(c) the person knows about the activity; and
(d) the activity is conducted at the permitted premises.
Maximum penalty: 50 penalty units.
(5) In this section:
"prohibited promotional activity" means an activity that—
(a) encourages excessive or rapid consumption of liquor; or
(b) is prescribed by regulation.
