PUBLIC UNLEASED LAND ACT 2013 - SECT 90

Identity cards

    (1)     This section applies in relation to an authorised person appointed under section 89 (1).

Note     An authorised person who is an investigator is issued with an identity card under the Fair Trading (Australian Consumer Law) Act 1992

, s 37.

    (2)     The director-general must give an authorised person an identity card stating the person's name and that the person is an authorised person.

    (3)     The identity card must show—

        (a)     a recent photograph of the authorised person; and

        (b)     the card's date of issue and expiry; and

        (c)     anything else prescribed by regulation.

    (4)     A person commits an offence if the person—

        (a)     stops being an authorised person; and

        (b)     does not return the person's identity card to the director-general as soon as practicable (but not later than 7 days) after the day the person stops being an authorised person.

Maximum penalty: 1 penalty unit.

    (5)     Subsection (3) does not apply to a person if the person's identity card has been—

        (a)     lost or stolen; or

        (b)     destroyed by someone else.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (5) (see Criminal Code

, s 58).

    (6)     An offence against this section is a strict liability offence.
