RESIDENTIAL TENANCIES ACT 1997 - SECT 61

Effect of abandonment

If a tenant abandons premises that the tenant occupies under a residential tenancy agreement, the agreement terminates on the day of abandonment.

Note     If there is a dispute about the date of abandonment, the parties may apply to the ACAT for an interim order declaring when the premises were abandoned (see ACT Civil and Administrative Tribunal Act 2008

, s 53).
