ENVIRONMENT PROTECTION REGULATION 2005 - REG 20

Motor vehicle emissions not taken to cause environmental harm

A pollutant being emitted into the air from a motor vehicle to which the Act applies is not taken to cause environmental harm if the motor vehicle complies with the

title="A1999-81">Road Transport (Vehicle Registration) Act 1999

.

Note 1     The Act applies to a pollutant emitted into the air by a motor vehicle being driven on a road only if the motor vehicle—

        (a)     is being driven on the road for the purpose of conducting reliability trials or speed tests; and

        (b)     has been exempted under the road transport legislation from the provisions of that legislation about attaching silencers to the exhaust pipes of motor vehicles, rules of the road and speed limits during the trials or tests (see

, s 8 (1) (e)).

Note 2     A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any regulation (see href="http://www.legislation.act.gov.au/a/2001-14" title="A2001-14">Legislation Act

, s 104).

Note 1     The Act does not apply to noise made by—

        (a)     a light rail vehicle or other train; or

        (b)     a Commonwealth jurisdiction aircraft; or

        (c)     a person using only the person's body; or

        (d)     an animal; or

        (e)     a motor vehicle being driven on a road, unless it—

              (i)     is being driven on the road to conduct reliability trials or speed tests; and

              (ii)     has been exempted under the road transport legislation from the provisions of that legislation about attaching silencers to the exhaust pipes of motor vehicles, rules of the road and speed limits during the trials or tests (see
