The Parliament of Australia enacts: 

3 

1  Short title 

4 

 

  This Act may be cited as the Parliamentary Service Amendment 

5 

(Freedom of Information) Act 2013. 

6 

2  Commencement 

7 

 

  This Act commences on the day this Act receives the Royal 

8 

Assent. 

9 

3  Schedule(s)

  Each Act that is specified in a Schedule to this Act is amended or 

11 

repealed as set out in the applicable items in the Schedule

Insert:

68A  Departments and office holders not prescribed authorities for 

6 

Freedom of Information Act purposes 

7 

 

  None of the following is a prescribed authority for the purposes of 

8 

the Freedom of Information Act 1982: 

9 

 

(a)  a Department of the Parliament that is established under this 

10 

Act; 

11 

 

(b)  a person who holds, or performs the duties of, an office 

12 

established under this Act. 

13 

2  Transitional 

14 

The Freedom of Information Act 1982 is taken to have had the effect it 

15 

would have had if: 

16 

 

(a)  each Department of the Parliament established under the 

17 

Parliamentary Service Act 1999 had been taken not to have 

18 

been a prescribed authority for the purposes of the Freedom 

19 

of Information Act 1982 at all times after the Department was 

20 

established under the Parliamentary Service Act 1999; and 

21 

 

(b)  each person who held, or performed the duties of, an office 

22 

established under the Parliamentary Service Act 1999 had 

23 

been taken not to have been a prescribed authority for the 

24 

purposes of the Freedom of Information Act 1982 by virtue 

25 

of his or her holding, or performing the duties of, that office.
