Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) If the Secretary needs further information to decide the application, the Secretary may give the applicant a written notice requiring the applicant to give the further information within 28 days after receiving the notice, or within such shorter period as is specified in the notice.
(2) The application is taken to be withdrawn if the applicant does not give the further information within the 28 days, or within the shorter period. However, this does not stop the applicant from reapplying.
Note: The period for giving the further information can be extended--see section 96 - 7.
(3) The notice must contain a statement setting out the effect
of subsection (2).
