AUSTRALIAN PASSPORTS ACT 2005 - SECT 37

Bringing, taking or sending a document across international borders

             (1)  A person commits an offence if:

                     (a)  the person:

                              (i)  brings a document into a country; or

                             (ii)  takes a document out of a country; or

                            (iii)  sends a document to or from a country; and

                     (b)  the person knows that:

                              (i)  the document is a false Australian travel document; or

                             (ii)  the document is an Australian travel document that was not issued to the person.

Penalty:  Imprisonment for 10 years or 1,000 penalty units, or both.

             (2)  Subsection (1) does not apply if the person has a reasonable excuse.

Note:          The defendant bears an evidential burden in relation to the matter in subsection (2). See subsection 13.3(3) of the Criminal Code .
