(1) This section applies in relation to goods if:
(a) the owner of the goods is liable to pay a cost - recovery charge, whether or not the charge relates to the goods; and
(b) the charge is due and payable; and
(c) any of the following applies in relation to the goods:
(i) the goods are subject to biosecurity control;
(ii) an exposed goods order or a biosecurity control order is in force in relation to the goods;
(iii) the goods are in a biosecurity response zone and biosecurity measures have been required in relation to the goods under a power that is specified in the biosecurity response zone determination under paragraph 366(2)(c) (powers to require biosecurity measures to be taken) or (d) (other biosecurity measures).
(2) A charge is created on the goods by force of this section to secure the payment of the cost - recovery charge.
