Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) A regulated person must not, in purported compliance with a provision of this Part, give a person a Statement that has been altered (otherwise than pursuant to paragraph (b)) after the date of the Statement if either or both of the following paragraphs applies:
(a) the alteration was not made by, or with the authority of, the issuer or seller, as the case requires, of the financial products;
(b) the alteration is a material alteration and the date of the Statement has not been changed to:
(i) if a copy of the altered Statement has been lodged with ASIC (see subsection (2))--the date on which it was so lodged; or
(ii) in any other case--the date on which the alteration was made.
Note: Failure to comply with this subsection is an offence (see subsection 1311(1)).
(2) If the alteration is a material alteration to a Statement
that has been lodged with ASIC under section 1015B, that section
applies to the altered Statement as if it were a new Statement.
