(1) If formal first preference votes were given for a candidate in an election, a payment may be made in respect of the candidate even if the candidate dies.
(2) If the candidate was neither:
(a) endorsed by a registered political party; nor
(b) a member of a group;
and was his or her own agent for the purposes of this Part, the payment may be made to the candidate's legal personal representative.
Death of member of group
(3) If group votes were given in a Senate election in relation
to a group of candidates, a payment may be made for the group even if a
candidate who was a member of the group dies.
