(1) The agreement making function of a representative body is to be a party to indigenous land use agreements.
(2) In performing its agreement making function in respect of an
area, a representative body must, as far as practicable, having regard to the
matters proposed to be covered by the agreement, consult with, and have regard
to the interests of, persons who hold or may hold native title in relation to
land or waters in that area.
