Commonwealth Consolidated Acts Commonwealth Consolidated ActsIf there is an approved determination of native title (the first determination ) in relation to a particular area, the Federal Court must not:
(a) conduct any proceeding relating to an application for another determination of native title; or
(b) make any other determination of native title;
in relation to that area or to an area wholly within that area, except in the case of:
(c) an application as mentioned in subsection 13(1) to revoke or vary the first determination; or
(d) a review or appeal of the first determination.
Note: Paragraph 13(1)(a) provides that no native title
determination application can be made in relation to an area for which there
is already an approved determination of native title.
