PERSONAL PROPERTY SECURITIES ACT 2009 - SECT 309

Guide to this Part

This Act starts to apply to the following at the registration commencement time (26 months after the Act is given the Royal Assent, or another time determined by the Minister):

  (a)   new security agreements;

  (b)   security interests arising after commencement;

  (c)   transitional security agreements and interests;

  (d)   new interests in personal property;

  (e)   prescribed personal property;

  (f)   migrated personal property data from Commonwealth, State and Territory registers.

Special provision is made for the following:

  (a)   the enforceability of transitional security interests;

  (b)   certain declared statutory interests;

  (c)   intellectual property licences;

  (d)   the enforcement generally of security agreements;

  (e)   the starting time for registrations;

  (f)   governing laws (under Part   7.2);

  (g)   constitutional and non - constitutional interests;

  (h)   charges, and fixed and floating charges.
