TRANS-TASMAN PROCEEDINGS ACT 2010 - SECT 61

Contempt of New Zealand courts or tribunals

  (1)   A person commits an offence if the person:

  (a)   is at a place in Australia from which a remote appearance is being made in a proceeding in a New Zealand court or tribunal ; and

  (b)   assault s :

  (ia)   a party to the proceeding; or

  (i)   a person appearing in the proceeding as a barrister, a solicitor , or both; or

  (ii)   a witness in the proceeding; or

  (iii)   an officer of an Australian court or tribunal giving assistance under section   63 .

Penalty:   2 years imprisonment or 120 penalty units , or both.

  (2)   A person commits an offence if the person:

  (a)   is at a place in Australia from which a remote appearance is being made in a proceeding in a New Zealand court or tribunal; and

  (b)   intentionally threaten s , intimidate s or insult s :

  (i)   a J udge , Associate Judge or member of the New Zealand court or tribunal who is taking part   i n the proceeding; or

  (ii)   a R egistrar, D eputy R egistrar or other officer of the New Zealand court or tribunal who is taking part   i n or assisting in the proceeding; or

  (iia)   a party to the proceeding; or

  (iii)   a person appearing in the proceeding as a barrister, a solicitor , or both; or

  (iv)   a witness in the proceeding.

Penalty:   2 years imprisonment or 120 penalty units , or both .

  (3)   A person commits an offence if the person:

  (a)   is at a place in Australia from which a remote appearance is being made in a proceeding in a New Zealand court or tribunal; and

  (b )   intentionally interrupt s or obstruct s the proceeding .

Penalty:   2 years imprisonment or 120 penalty units , or both.

  (4)   A person commits an offence if the person:

  (a)   is at a place in Australia from which a remote appearance is being made in a proceeding in a New Zealand court or tribunal; and

  (b )   intentionally disobey s an order or direction of the New Zealand court or tribunal .

Penalty:   2 years imprisonment or 120 penalty units , or both.
