FEDERAL COURT RULES 2011 - RULE 36.52

Assistance from Registrar

  (1)   A party who requires a Registrar's assistance to settle the index to Part A of the appeal book or Part B of the appeal book must, within 7 days after the notice of appeal has been served, apply in writing to a Registrar.

  (2)   If there is no application by any party under subrule (1), the appellant must, within 28 days after the service of the notice of appeal, submit to a Registrar a draft of:

  (a)   the index to Part A of the appeal book; and

  (b)   Part B of the appeal book.

  (3)   A Registrar will settle the draft of the index to Part A of the appeal book and Part B of the appeal book and tell the appellant that a Registrar has approved the drafts, in the settled form.

  (4)   The appellant must, within 14 days after being notified of a Registrar's approval, file:

  (a)   Part A, including all documents, indexed and ordered according to a unique tab number; and

  (b)   Part B.

Note:   A party should have regard to the Practice Note for Appeals that has been issued for the assistance of parties.
