CORPORATIONS ACT 2001 No. 50, 2001 - SECT 1393
Transitional provisions relating to section 1351
fees (1) If:
- (a)
- either:
- (i)
- before the commencement, a person paid an amount as required by
section 1351 of the old Corporations Law of a State or Territory in
respect of a particular matter; or
- (ii)
- after the commencement, a person pays an amount as required by
subsection 9(2) of the Corporations (Fees) Act 2001 in respect of a
particular matter; and
- (b)
- a fee is also payable under section 1351 of this Act in respect of
the same matter;
the payment they made or make as mentioned in subparagraph (a)(i) or (ii)
is taken to satisfy their liability to pay the fee referred to in
paragraph (b).
(2) If:
- (a)
- before the commencement, a person paid a deposit as required by
section 1357 of the old Corporations Law of a State or Territory in
respect of a particular matter; and
- (b)
- a fee is payable under section 1351 of this Act in respect of the
same matter;
the deposit must be applied against the liability to pay the fee.
