NAVIGATION ACT 2012 (NO. 128, 2012) - SECT 118

             (1)  A person contravenes this subsection if:

                     (a)  dangerous goods are or will be carried on a vessel; and

                     (b)  the person describes the sender of the goods:

                              (i)  on the packaging containing the goods; or

                             (ii)  on any document relating to the carrying of the goods; and

                     (c)  the description is false or misleading in a material particular.

Fault-based offence

             (2)  A person commits an offence if the person contravenes subsection (1).

Penalty:  Imprisonment for 12 months or 60 penalty units, or both.

Civil penalty

             (3)  A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty:          600 penalty units.
