NAVIGATION ACT 2012 (NO. 128, 2012) - SECT 317

Certificates to be made available

             (1)  A person contravenes this subsection if:

                     (a)  the person is the owner or master of a vessel; and

                     (b)  a certificate under this Act is in force in relation to the vessel; and

                     (c)  a copy of the certificate is not made available at all reasonable times for examination on request by any of the following:

                              (i)  any person on board the vessel;

                             (ii)  AMSA;

                            (iii)  an inspector;

                            (iv)  an officer of Customs.

Fault-based offence

             (2)  A person commits an offence if the person contravenes subsection (1).

Penalty:  Imprisonment for 12 months or 60 penalty units, or both.

Civil penalty

             (3)  A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty:          600 penalty units.
