TRADE MARKS ACT 1995 No. 119 of 1995 - SECT 174

Registrar to reject application or send it to Commission
174. (1) If, after examining the application, the Registrar is satisfied that:

   (a)  the application has been made in accordance with this Act; and

   (b)  there are no grounds for rejecting it; the Registrar must send to the
        Commission a copy of the application and of any prescribed document.

(2) If the Registrar is not satisfied as set out in paragraph (1)(b), he or
she must:

   (a)  reject the application; and

   (b)  give notice of the decision to the applicant.

(3) The Registrar may not reject the application without giving the applicant
an opportunity of being heard.
