TRADE MARKS ACT 1995 No. 119 of 1995 - SECT 83

Amendment of particulars of trade mark entered in Register
83. (1) Subject to Part 11, the Registrar may, at the written request of the
registered owner of a registered trade mark:

   (a)  amend the representation of the trade mark as entered in the Register
        if the amendment does not substantially affect the identity of the
        trade mark as at the time when the particulars of the application for
        the registration of the trade mark were published under section 30; or

   (b)  amend any particulars entered in the Register relating to any goods or
        services in respect of which the trade mark is registered if the
        amendment does not have the effect of extending the rights that (apart
        from the amendment) the owner has under the registration; or

   (c)  amend, or enter in the Register, any other particular in respect of
        the trade mark if the amendment or entry does not have the effect of
        extending the rights that (apart from the amendment or entry) the
        owner has under the registration. Note: For registered owner,
        registered trade mark and Register see section 6.

(2) An appeal lies to the Federal Court from a decision of the Registrar under
subsection (1). Note: See sections 215 and 216 for amendments of the Register
to record changes in addresses for service and in the names of registered
owners etc.
