1979 No. 140 FEDERAL COURT RULES - RULE 24.11

Default of witness
11. (1) Where a person has been required by subpoena to attend before an
examiner, and he refuses to be sworn for the purposes of the examination or to
answer any lawful question, or to produce any document or thing, the examiner
shall, at the request of any party, give to that party a certificate, signed
by the examiner, of the refusal.

(2) The Court may, upon the certificate being filed, and on motion by any
party-

   (a)  order that person to be sworn, or to answer the question or to produce
        the document or thing as the case may be; and

   (b)  order that person to pay any costs occasioned by his refusal.
