1979 No. 140 FEDERAL COURT RULES - RULE 40.7

7. (1) Subject to sub-rule (2), the evidence in support of the charge shall be
by affidavit.

(2) The Court may permit evidence in support of the charge to be given
otherwise than by affidavit.
