1979 No. 140 FEDERAL COURT RULES - RULE 42.2

2. (1) An action by or against two or more persons claiming as partners or
against two or more persons claimed to be liable as partners and who carry on
business in partnership within Australia may be brought in the partnership
name.

(2) The partnership name shall be that obtaining at the time the cause of
action arose.

(3) Where the proceeding is commenced pursuant to sub-rule (1), unless the
Court otherwise orders, it shall continue in the partnership name, and not in
the names of the individual partners.
