1979 No. 140 FEDERAL COURT RULES - RULE 50.4

Party having carriage of the proceeding
4. Where a question is referred to the Court by a Tribunal or the Conciliation
and Arbitration Commission, the party having the carriage of the proceeding
for the purposes of rule 2 shall be-

   (a)  where the question is referred by the Tribunal or Commission at the
        request of a party-that party;

   (b)  where the question is referred by a Tribunal of its own motion-the
        person who made the decision to which the proceeding before the
        Tribunal relates; and

   (c)  where the question is referred by the Commission of its own
        motion-such party as the Commission appoints for that purpose.
