Subject: Australian Federal Police Act 1979

Australian Federal Police Amendment Regulations 2001 (No. 1)

Section 70 of the Australian Federal Police Act 1979 (the Act) provides that the GovernorGeneral may make Regulations for, inter alia, prescribing all matters required or permitted to be prescribed, or for otherwise carrying out or giving effect to the Act. Subsection 20(2) of the Act provides that the Commissioner of the Australian Federal Police shall be paid such allowances as are prescribed.

The Australian Federal Police Regulations 1979 (the Principal Regulations) made under the Act sets out various matters necessary to give effect to the Act, including prescribing certain allowances to be paid to the Commissioner. The purpose of the Regulations is to remove provision for an allowance no longer required to be paid to the Commissioner.

Regulation 7 of the Principal Regulations prescribed that the Commissioner is to be paid a displacement allowance of $13,500 per annum. The allowance was paid to compensate the Commissioner for disruption to career continuity and location of employment whilst employed in the position of Commissioner. Mr Michael Keelty, previously a Deputy Commissioner with the Australian Federal Police, was appointed as Commissioner on 22 March 2001. As the new Commissioner will not be displaced in either career continuity or locality, it is no longer necessary to pay the allowance to the Commissioner. The Regulations therefore omit Regulation 7 from the Principal Regulations.
