Air Navigation (Charges) Regulations (Amendment)

Subsection 6(1) of the Air Navigation (Charges) Act 1952 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.

The Act provides for the payment of landing charges at aerodromes that are either maintained, operated or provided by the Commonwealth or in respect of the maintenance or operation of which financial assistance is provided by the Commonwealth. Section 5 of the Act provides that charges are payable in accordance with the Air Navigation (Charges) Regulations (the Regulations). The rate of landing charges is set out in regulation 12 and in the Schedule to the Regulations.

The amendments to the Regulations change the charge levied at Newcastle aerodrome (Item 132 of the Schedule) from $12.00 per 1,000 kilograms down to $9.00 per 1,000 kilograms. This change is based on revised movement figures for that aerodrome.

These amendments are taken to have commenced as from 1 February 1992, which is the date at which the $12.00 per 1,000 kilograms charge was imposed at Newcastle aerodrome. Although the change is retrospective, it does not adversely affect any person's rights, duties, or obligations (other than the Commonwealth's) since it lowers the landing charge levied at the aerodrome.
