EXPLANATORY STATEMENT

Civil Aviation (Fees) Amendment Regulations 2007 (No. 1)

 

 

Subsection 98 (1) of the Civil Aviation Act 1988 (the Act) provides, in part, that the Governor-General may make regulations, not inconsistent with the Act, prescribing matters required or permitted by the Act, or necessary or convenient for carrying out or giving effect to the Act.

 

Under paragraph 98 (3) (u) of the Act, the power to make regulations includes the power to make regulations prescribing fees, either by specifying amounts or by prescribing a method of calculation, for services, applications or requests, or the doing of anything under the Act, the regulations or the Civil Aviation Orders (the CAOs).

 

The Civil Aviation (Fees) Amendment Regulations 2007 (No. 1) (the new Fees Regulations) amend the Civil Aviation (Fees) Regulations 1995 (the old Fees Regulations) to revise and extend the list of services for which fees may be charged by the Civil Aviation Safety Authority (CASA), and to increase the level of fixed fees and hourly rates. This is required as part of CASA’s move to full cost recovery for its services in line with the Australian Government’s policy on cost recovery.

 

Cost recovery policies

The Australian Government has adopted a formal cost recovery policy under which Government agencies should improve the consistency, transparency and accountability of their cost recovery arrangements and promote the more efficient allocation of their resources.

 

Under this policy, cost recovery broadly encompasses fees and charges for the provision of government goods and services (including regulation) to the private and other non-government sectors of the economy.

 

The government has issued Commonwealth Cost Recovery Guidelines for Information and Regulatory Agencies. These guidelines apply to all Australian Government agencies and authorities and have been developed to assist the design and implementation of the policy. Agencies and authorities are responsible for reviewing all cost recovery arrangements against these guidelines.

 

Response to cost recovery policies

CASA’s functions under the Act include the provision of safety regulatory services to the aviation industry. For many of these services, CASA has cost recovery arrangements in place.

 

A number of services were specified under the old Fees Regulations and fees were charged at either a fixed rate for particular services, or at an hourly rate based on the number of hours taken to provide the service. These services were charged across various elements of the aviation industry, but predominantly impact on licence and certificate holders.

In accordance with cost recovery policy, and in the context of its Long Term Funding Strategy (LTFS), CASA has carried out a rigorous cost recovery review involving examination of its operating costs and review of its activity levels to identify efficiencies and contain costs.

 

The LTFS for financial self-sustainability provides for an in-flow of revenue from cost recovery of $10.5m per annum from 1 January 2006 (the first phase), and $15m per annum from 1 July 2007 (the second phase). To ensure adequate time for the consultation process, the full cost recovery implementation program is comprised of 3 phases over a 3-year period that commenced on 1 January 2006. The new Fees Regulations represent the second phase of this process.

 

The cost recovery review for the second phase examined how best to achieve the LTFS targets by expanding the number of services for which CASA may charge a fee to the aviation industry on a cost recovery basis, and by increasing some of the fees in line with increased costs to CASA for providing the services.

 

To assist with implementing the second phase of its LTFS, CASA embarked on a significant consultation and communication program with the aviation industry about possible fee increases and new fee items (see further details below).

 

Costing CASA services

CASA reviewed and revised its cost modelling analysis to confirm and maintain the accuracy of its activity costing on which fees are based. The fixed and hourly rate fees charged under the new Fees Regulations reflect the calculations and outcome of this analysis. The new Fees Regulations continue to have 24 service categories covering a total of 231 fee items (including fees for aviation security related matters). Details of the activity costing process appear in the Cost Recovery Impact Statement (CRIS) certified by the Department of Finance and Administration and mentioned below.

 

Fee levels

Under the old Fees Regulations, there were 2 hourly rates of $130 and $150. The higher rate was payable where the service required a senior CASA officer, or an officer with particular experience or qualifications, such as an air transport Flying Operations Inspector. In addition, fixed fees were determined based on the $130 per hour rate for the usual length of time taken by CASA to complete a relatively predictable service routine that does not vary significantly from customer to customer.

 

Under the new Fees regulations, there are 4 hourly rates of $190, $160, $130, and $100. The highest rate of $190 is payable where the service requires a senior CASA officer, or an officer with particular experience or qualifications, such as an air transport Flying Operations Inspector. For most regulatory services not requiring this higher level of seniority and experience, the next hourly rate of $160 is chargeable.

 

Most fixed fees are determined based on the underlying rate of $160 per hour for the usual length of time taken by CASA to complete a relatively predictable service routine that does not vary significantly from customer to customer.

 

For some services which are delivered primarily by administrative rather than technical staff, the cost recovery hourly rate will be $130 or $100 per hour depending on the level of administrative staff involved in delivering the service. There was no equivalent to this approach in the old Fees Regulations.

 

 

 

Aviation security status checking

Fees for aviation security status checking and related matters have risen. Aviation security status checking for CASA will be conducted on a fee for service basis by the Attorney-General’s Department. The higher fees primarily include these third party costs to CASA. There is also a component to cover the cost of CASA’s processing of applications for checking.

 

Travel costs

There will no longer be a separate fee equivalent to the reasonable cost of travel and related expenses for services delivered in Australia. However, a separate fee equivalent to such costs will be chargeable where the service is provided outside Australia.

 

Overseas inspections

In addition, where CASA has provided a regulatory service to a person outside Australia, travel expenses and the appropriate hourly rate fee will be charged where CASA considers that it is necessary to travel overseas to conduct a periodic safety audit or inspection on the premises, operations or activities of the person. Under the old Fees Regulations, such charges were payable for the renewal of certificates about to expire but not for perpetual certificates. Under the new Fees Regulations, the charges will be payable where CASA provides a service to a person outside Australia and CASA considers that it is necessary in the interests of safety for a CASA officer or another person on CASA’s behalf to travel outside Australia to conduct an inspection and prepare a report.

 

Waivers

CASA will have a power to waive the payment of fee or part of a fee if there are special circumstances which make it inappropriate for the fee to be payable.

 

For example, from time to time it is appropriate to waive the payment of some fees by operators or pilots engaged in certain aviation fund-raising activities for charitable organisations. Also, from time to time, as it refines its safety rules and administration, CASA may require certain classes of operators or pilots to be re-issued with updated authorisations that reflect new administrative arrangements. The operators or pilots should not be required to pay fees for appropriate charitable fund raising or for documentation re-issued at CASA’s initiative to facilitate the introduction of new administrative processes or systems.

 

Participation in CASA-approved trials of operations or technology is another example where it may be inappropriate for the fee to be payable. Here the longer term goal is to benefit aviation as a whole and it may be unfair to charge individual participants for the CASA services required to establish the trial. The absence of a waiver power can have the effect of making the payment of fees for such matters unavoidable.

 

Medical certificates

A new regulation, commencing on 1 June 2007, 1 month earlier than the other provisions in the Regulations, provides for the payment of reduced medical certificate fees if a person applies in June 2007 and completes the necessary medical examination and declaration during that month. The reduced fee will apply from 1 July 2007 also.

 

Transitional provisions

The new Fees Regulations include a number of transitional provisions based on those in the old Fees Regulations. These are designed to allow for a reasonably smooth and predictable transition to the new fee items and fee rates. Details are set out in Attachment 1.

 

 

 

Consultation

The new Fees Regulations are a legislative instrument for the purposes of the Legislative Instruments Act 2003 (the LIA).

 

Consistent with section 17 of the LIA, CASA conducted a program of public consultation which involved extensive public and private consultation with the aviation industry.

 

Senior representatives of the aviation industry attended critical meetings of CASA’s internal fees policy management committee, the Pricing Group, during the process of developing and approving the proposed new Fees Regulations.

 

Drafts of the proposed fee changes were widely published, initially in August 2006 and again, in revised form, in November 2006. The November 2006 revisions largely arose from the feedback received from the August 2006 exposure of the proposals.

 

As a critical component of that August 2006 exposure, CASA convened 7 major industry forums in Cairns, Brisbane, Bankstown, Hobart, Moorabbin, Perth and Adelaide to encourage and facilitate direct and indirect industry feedback. This first consultation period was kept open for correspondence and comment until the end of October 2006.

 

CASA received over 170 e-mails and just under a dozen other letters in the first round of consultation.

 

The second round of consultation closed on 12 January 2007. CASA received over 90

e-mails, and more detailed submissions from the Aircraft Owners and Pilots Association, the Regional Aviation Association of Australia and Regional Express Pty Limited.

 

CASA took all consultation material into account in determining the appropriate scope and level of fees. For example, the decision to abolish domestic travel fees was made in direct response to representations made during the consultation process.

 

Office of Best Practice Regulation

The Office of Best Practice Regulation (OBPR) has assessed that the preparation of a Regulation Impact Statement is not required for the new Fees Regulations. CASA has, however, prepared and certified with the Department of Finance and Administration a cost recovery impact statement (a CRIS) in accordance with Financial Management Guidelines. The CRIS is available on the CASA website.

 

Commencement

Following registration, the new fees for medical certificates commence on 1 June 2007. All other fee amendments commence on 1 July 2007.

 

Details of fees

Details of the new Fees Regulations are in Attachment 1. Specific details of the full range of CASA services and fees are in Attachment 2. Specific details of the fee items which are new, or which have increased, decreased or remained the same, or which have been transformed from fixed fees to hourly rate, are in Attachment 3. The descriptions of some fee items under the old Fees Regulations have been redrafted for clarity of application. The items and fees continue to be set out under the headings that were used in the old Fees Regulations.

 

Otherwise, to assist with financial and other monitoring, every effort has been made to maintain consistency between the item numbers of services under the old and the new Fees Regulations.

 


ATTACHMENT 1

 

 

Details of the Civil Aviation (Fees) Amendment Regulations 2007 (No. 1)

 

Regulation 1 — Name of Regulations

Regulation 1 names the Regulations as the Civil Aviation (Fees) Amendment Regulations 2007 (No. 1) (the new Fees Regulations).

Regulation 2 — Commencement

Regulation 2 provides that regulations 1 to 3 and Schedule 1 commence on 1 June 2007 and that regulation 4 and Schedule 2 commence on 1 July 2007.

Regulation 3 — Amendment of Civil Aviation (Fees) Regulations 1995

Regulation 3 provides that Schedules 1 and 2 amend the Civil Aviation (Fees) Regulations 1995 (the old Fees Regulations).

Regulation 4 — Transitional

Regulation 4 is a transitional provision. Subregulation 4 (2) provides that if, under the old Fees Regulations, a fixed fee was payable for a service, and the person applied for the service and paid the old fee before 1 July 2007, no additional fee is payable under the new Fees Regulations even if the service is provided on or after 1 July 2006.

Subregulation 4 (3) provides that if, under the old Fees Regulations, a fee computed at an hourly rate was payable, and the person applied for the service before 1 July 2007 and received from CASA its written estimate of the amount of the fees payable, and CASA did not provide the service before 1 July 2007, the service must continue to be charged at the old hourly rate until the end of 30 September 2007.

Subregulation 4 (4) provides that if, under the new Fees Regulations, a fee computed at an hourly rate is payable but no fee was payable for the service under the old Fees Regulations, if a person applied for the service before 1 July 2007 the fee computed at the hourly rate is payable for the service only to the extent that the service is provided on or after 1 July 2007.

Schedule 1 — Amendment commencing on 1 June 2007

Item [1] — New regulation 4AA

Item [1] provides that despite regulation 4, the fee payable by a person for the issue of a medical certificate is $75 if, during the month of June 2007, the person undergoes a medical examination with a designated aviation medical examiner, signs a medical questionnaire for the medical examination and lodges an application with CASA for the medical certificate.

  Schedule 2 — Amendments commencing on 1 July 2007

Item [1] — Subregulation 3 (1)

Item [1] inserts two new definitions to explain the acronyms ASETPA (approved single engine turbine powered aeroplane) and ASIC (aviation security identification card).

Item [2] — Subregulation 4 (1)

Item [2] substitutes a new subregulation 4 (1).

 

New subregulation 4 (1) provides that for paragraphs 98 (3) (u) and (v) of the Civil Aviation Act 1988 the fee for a service specified in an item in Schedule 1 is the amount specified in the item, or if the item contains the notation ‘HR’, is the amount calculated by the formula Rate N. ‘Rate’ and ‘N’ are defined in subregulation 4 (2), inserted by item [3] mentioned below.

Item [3] — Subregulation 4 (2)

Item [3] substitutes a new subregulation 4 (2).

 

New subregulation 4 (2) indicates that in the formula ‘N’ is the number of hours spent by CASA officers in the provision of the service and the ‘Rate’ is as specified in subregulation 4 (2).

 

New subparagraph 4 (2) (a) (i) provides that the hourly rate for a service in items 2.12, 2.12A, 2.13, 2.14, 2.16, 2.17 and 15.9 of Schedule 1 which is inserted by item [10] is $130.

 

New subparagraph 4 (2) (a) (ii) provides that the hourly rate for a service in items 24.2, 24.5 and 24.8 will be $100.

 

New paragraph 4 (2) (b) provides that if the interests of the safety of air navigation require that the service be provided by a senior CASA officer, or a CASA officer with particular experience or qualifications, the hourly rate for the service is $190.

 

New paragraph 4 (2) (c) provides that in all other cases the hourly rate is $160 per hour.

 

An example explains that a service in a general aviation matter is likely to be charged at $160 per hour, and a service provided by an air transport Flying Operations Inspector at $190 per hour.

Item [4] — Subregulation 4 (6)

Item [4] amends subregulation 4 (6) so that CASA may only charge a separate fee for travel when the travel is outside Australia.

 

Item [5] — New subregulation 4 (6A)

Item [5] inserts a new subregulation 4 (6A).

New subregulation 4 (6A) provides that if a service is provided to or for a person outside Australia, and following provision of the service, CASA considers that it is necessary in the interests of the safety of air navigation to inspect, assess and report on the person’s premises, operations or activities, and for this purpose requires a CASA officer or another person acting on CASA’s behalf to travel outside Australia, then a fee is payable equal to reasonable travel-related costs and a fee is payable at the hourly rate of $160 or $190, depending on the required seniority or experience of the CASA officer.

Item [6] — Regulation 4AA

Item [6] omits new regulation 4 AA, as inserted by item [1] of Schedule 1 to the new fees regulations for certain applications for medical certificates lodged in June 2007, which will no longer be required on and after 1 July 2007. Regulation 4AA facilitates early introduction of the lower medical certificate fees and is not required on and after 1 July 2007 because Part 15 of Schedule 1, inserted by item [10], provides for the reduced medical certificate fees from 1 July 2007.

 

Item [7] — Subregulation 5 (2), table

Item [7] replaces the table in subregulation 5 (2) to provide new fees and more accurate service descriptions for the processing and consideration of applications for aviation security status checks, verifications of identity for security designated authorisations, and replacement of aviation identification documents.

Item [8] — Subregulation 5 (4)

Item [8] replaces the table in subregulation 5 (4) to provide new fees and more accurate service descriptions for the processing and consideration of applications for the issue or replacement of aviation security identification cards (ASICs).

 

Item [9] — New regulation 6

Item [9] provides a new regulation 6 to enable CASA to waive the payment of a fee or a part of a fee under the Regulations if CASA determines that special circumstances exist which make it inappropriate for the fee to be payable.

Item [10] — Schedule 1 — Fees for aviation regulatory services

Item [10] replaces Schedule 1 to the old Fees Regulations with a new Schedule 1. New Schedule 1 lists by item, under appropriate headings, the services for which CASA charges the fees that are mentioned for each item.

 

New Schedule 1 includes, in redrafted form and under the same headings, the services for which fees are already being charged, along with some services for which fees are being charged for the first time. It contains for each service the appropriate fixed fee or hourly rate that, subject to the transitional provisions in regulation 4, is charged from 1 July 2007.

 

The detail for each service and fee is set out in Attachment 2.

 

Attachment 3 contains information, by reference to the item numbers in Attachment 2, about which fee items are new and which fees rates or levels have been varied by the new Fees Regulations.
