Commonwealth Services Delivery Agency Regulations

The Commonwealth Services Delivery Agency Act 1997 (the Act) provides for the establishment of the Commonwealth Services Delivery Agency (the Agency). Section 41 of the Act gives the Governor-General the power to make regulations under the Act. The Act commences on 1 July 1997.

The Agency will be responsible for delivering various Commonwealth services that are currently provided by a variety of Commonwealth departments.

The formal name of the Agency is the Commonwealth Services Delivery Agency". Section 38 of the Act protects this name from unauthorised use in relation to a business, trade, profession or occupation, etc. Subsection 38(4) allows other names to be prescribed as a "protected name". It also allows for a symbol to be prescribed as the "protected symbol" of the Agency. The symbol is, similarly, protected from unauthorised use.

The attached regulation prescribes that "Centrelink" is a protected name of the Agency. It also contains a symbol that is prescribed as the protected symbol of the Agency.

Despite the fact that the Act has not commenced, the making of the regulation at this time is authorised by section 4 of the Acts Interpretation Act 1901.
