Diesel and Alternative Fuels Grants Scheme Regulations 2000

Section 63 of the Diesel and Alternative Fuels Grants Scheme Act 1999 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.

Section 6 of the Act prescribes the metropolitan areas for the purposes of section 10 of the Act and further provides that the area included in each metropolitan area is the area specified in the regulations.

The purpose of the regulations is to specify the areas to be included in each metropolitan area referred to in subsection 6(1) of the Act.

The Act introduces a grant for certain road transport in order to provide diesel credits for rural and regional Australia, where transport costs are more pronounced, while addressing concerns relating to the environmental impact of diesel use in large cities by reducing the range of vehicles eligible for diesel credits. The grant will be available from 1 July 2000 until 30 June 2002 for the use of diesel fuel and other fuels as alternatives to diesel fuel, where the fuel is used in carrying on an enterprise. The grant will be available for all on road use of these fuels in vehicles weighing 20 tonnes or more and, with certain. restrictions, for vehicles weighing 4.5 tonnes to 20 tonnes used for transporting goods or passengers. Subsection 10(2) of the Act, provides, among other things, that for vehicles under 20 tonnes, the grant is not available for use of the relevant fuels for a journey which is undertaken entirely within a metropolitan area.

The regulations specify the areas which are to be included in each metropolitan area.
