Designs Act 1906

Designs Amendment Regulations 2001 (No. 1)

Section 41 of the Designs Act 1906 (the Act') provides for the Governor-General to make regulations for the purposes of the Act and for the conduct of any business relating to the Designs Office.

The powers or functions of the Registrar of Designs ('the Registrar') may be delegated, under section 8A of the Act and subregulation 50AA (1) of the Designs Regulations 1982 ('the Regulations'), to persons employed in the offices prescribed in Part 1 of Schedule 2B of the Regulations. The office of APS Level 5 is currently not prescribed in Part 1 of Schedule 2B to the Regulations

These regulations amend the Regulations to include the office of 'APS Level 5 - Examiner of Designs' to the list of offices of persons to whom the Registrar may delegate certain of the Registrar's powers under the Act.

Details of the amendments made by these regulations are as follows:

Regulation 1 identifies the amending regulations as the Designs Amendment Regulations 2001 (No. 1).

Regulation 2 specifies that the regulations will commence on gazettal.

Regulation 3 specifies that Schedule 1 amends the Designs Regulations 1982.

Item 1 of Schedule 1 amends Part 1 of Schedule 2B to the Regulations by inserting the office of 'APS Level 5 - Examiner of Designs'. This amendment will enable the Registrar to delegate certain of the Registrar's powers under the Act to persons employed in this office.
