Health Insurance (1995-1996 Pathology Services Table) Regulations

Section 133 of the Health Insurance Act 1973 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.

Section 9 of the Act provides, in effect, that Medicare benefits shall be calculated by reference to the fees for medical services (including pathology services) set out in the (which includes the pathology services table) in Schedule 1A to the Act.

Section 4A of the Act provides, among other things, that the regulations may prescribe a table of pathology services in accordance with the form of table set out in Section 4A(1) and that, upon commencement of a regulation prescribing a table of pathology services, the table so prescribed has effect as if it were set out in Section 4A(1) 1A in place of the table in that Section, The Health Insurance (1995-1996 Pathology Services Table) Regulations (the principal regulations) prescribe such a table.

Regulation 3 prescribes the new Pathology Services Table for 1995-1996 which sets down the pathology tests eligible for payment of medicare benefits and the amount of the rebates.

Regulation 4 repeals Statutory Rules 1994 Nos. 233 and 361, and Statutory Rules 1995 Nos. 133 and 155 which constitute the Health Insurance (1994-1995 Pathology Services Table) Regulations.

The 1995-1996 Pathology Services Table replicates the 1994-1995 Pathology Services Table, as amended an 1 July 1995, and is being introduced because under sub-section 4A(2) of the Health Insurance Act 1973 the latter ceases to be in force on 27 September 1995.

These Regulations will have effect from 28 September 1995.
