Immigration (Education) Charge Act 1992

Immigration (Education) Charge (Amendment) Regulations 2000 (No. 1)

Section 10 of the Immigration (Education) Charge Act 1992 (the Act) provides that the GovernorGeneral may make regulations prescribing matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for carrying out or giving effect to the Act.

The purpose of the Regulations is to make amendments consequential to amendments to the Migration Regulations 1994 which omit Subclass 833 (Certain Unlawful Non-Citizens) from Schedule 2 to the Migration Regulations 1994. The criteria contained in Subclass 833 has been absorbed into Subclass 832 (Close Ties). In the Regulations classes are set out in Schedule 1 and comprise one or more subclasses. A subclass contains a set of criteria prescribed in Schedule 2. An application for a visa of a particular class thus entitles the applicant to be considered against the criteria for all the subclasses within that class. A decision to grant a visa of a class signifies that the requirements for the grant of a visa of that class have been met.

The Regulations commence on 1 July 2000.

Regulation 1 - Name of Regulations

This regulation provides that these Regulations are the Immigration (Education) Charge Amendment Regulations 2000 (No. 1).

Regulation 2 - Commencement

The Regulations commence on 1 July 2000.

Regulation 3 - Amendment

The Immigration (Education) Charge Regulations are amended by these Regulations.

Schedule 1 - Amendments

Item 1 - Regulation 1

This item renames the Immigration (Education) Charge Regulations as the Immigration (Education) Charge Regulations 1993.

Item 2 - Subparagraph 5(1)(a)(ixb)

This item omits subparagraph 5(1)(a)(ixb) consequential to the omission of Subclass 833 (Certain Unlawful Non-Citizens) from Schedule 2 to the Migration Regulations 1994.
